M\u016f\u017eete jim poskytnout volno s n\u00e1hradou mzdy a po\u017e\u00e1dat si o<strong> vratku t\u00e9to n\u00e1hrady u \u010cSSZ.<\/strong> Od 1. 1. 2024 v\u0161ak u mzdov\u00fdch n\u00e1hrad p\u0159i pracovn\u00edm volnu na akce pro d\u011bti a ml\u00e1de\u017e<strong> do\u0161lo ke zm\u011bn\u00e1m v&nbsp;\u00fahrad\u00e1ch a&nbsp;podm\u00ednk\u00e1ch<\/strong>. Zorientujte se v nov\u00fdch pravidlech a&nbsp;p\u0159ipome\u0148te si i ta, kter\u00e1 z\u016fst\u00e1vaj\u00ed stejn\u00e1.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Kdo m\u00e1 n\u00e1rok na pracovn\u00ed volno b\u011bhem t\u00e1bora pro d\u011bti?<\/strong>&nbsp;<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Pracovn\u00ed volno s n\u00e1hradou mzdy p\u0159\u00edslu\u0161\u00ed pouze zam\u011bstnanc\u016fm <strong>v pracovn\u00edm pom\u011bru<\/strong>, nikoliv zam\u011bstnanc\u016fm s dohodami mimo pracovn\u00ed pom\u011br (DPP, DP\u010c). Toto pracovn\u00ed volno je br\u00e1no jako <strong>p\u0159ek\u00e1\u017eka pro jin\u00fd \u00fakon v obecn\u00e9m z\u00e1jmu<\/strong> a&nbsp;zam\u011bstnavatel je <strong>povinen<\/strong> sv\u00e9ho zam\u011bstnance uvolnit, pokud tomu nebr\u00e1n\u00ed v\u00e1\u017en\u00e9 provozn\u00ed d\u016fvody.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Zam\u011bstnavatel v\u017edy uvoln\u00ed sv\u00e9ho zam\u011bstnance na <strong>nezbytn\u011b nutnou dobu<\/strong>, nejv\u00fd\u0161e v\u0161ak na <strong>3 t\u00fddny v kalend\u00e1\u0159n\u00edm roce<\/strong>, pokud zam\u011bstnanec na t\u011bchto akc\u00edch vykon\u00e1v\u00e1 \u010dinnost:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>vedouc\u00edho t\u00e1bor\u016f pro d\u011bti a ml\u00e1de\u017e,&nbsp;<\/li>\n\n\n\n<li>z\u00e1stupce vedouc\u00edho pro v\u011bci hospod\u00e1\u0159sk\u00e9 a zdravotn\u00ed,&nbsp;<\/li>\n\n\n\n<li>odd\u00edlov\u00e9ho vedouc\u00edho,&nbsp;<\/li>\n\n\n\n<li>vychovatele,&nbsp;<\/li>\n\n\n\n<li>instruktora,&nbsp;<\/li>\n\n\n\n<li>st\u0159edn\u00edho zdravotnick\u00e9ho pracovn\u00edka,&nbsp;<\/li>\n\n\n\n<li>nebo obdobn\u00e9 \u010dinnosti na sportovn\u00edch soust\u0159ed\u011bn\u00edch d\u011bt\u00ed a ml\u00e1de\u017ee.&nbsp;<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Zam\u011bstnavatel si nicm\u00e9n\u011b m\u016f\u017ee za\u017e\u00e1dat o <strong>refundaci od \u010cSSZ pouze za 1 t\u00fdden<\/strong> pracovn\u00edho volna zam\u011bstnance.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Volno <strong>nelze \u010derpat<\/strong> na akc\u00edch a soust\u0159ed\u011bn\u00edch, kter\u00e9 jsou po\u0159\u00e1d\u00e1ny jako sou\u010d\u00e1st \u0161koln\u00ed doch\u00e1zky.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Pojem t\u00e1bor a sportovn\u00ed soust\u0159ed\u011bn\u00ed pr\u00e1vn\u00ed \u00faprava <strong>nijak nedefinuje<\/strong>, ale jedn\u00e1 se o \u010dasov\u011b ohrani\u010denou akci pro d\u011bti a ml\u00e1de\u017e, bez ohledu na dobu trv\u00e1n\u00ed a po\u010det \u00fa\u010dastn\u00edk\u016f a tak\u00e9 bez ohledu na to, zda jde o akci pobytovou, \u010di nikoliv.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Podm\u00ednky z\u00edsk\u00e1n\u00ed pracovn\u00edho volna<\/strong>&nbsp;<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Aby v\u016fbec zam\u011bstnanec mohl z\u00edskat pracovn\u00ed volno, mus\u00ed splnit ur\u010dit\u00e9 podm\u00ednky a jejich spln\u011bn\u00ed zam\u011bstnavateli tak\u00e9 <strong>prok\u00e1zat<\/strong>. Pokud tak neu\u010din\u00ed, tak <strong>nem\u00e1 n\u00e1rok na n\u00e1hradu mzdy<\/strong> a zam\u011bstnavatel pot\u00e9 ani nem\u016f\u017ee dolo\u017eit n\u00e1rok na refundaci od \u010cSSZ. Podm\u00ednky jsou n\u00e1sleduj\u00edc\u00ed:&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>1\/ Zam\u011bstnanec nejm\u00e9n\u011b 1 rok p\u0159ed uvoln\u011bn\u00edm pracoval soustavn\u011b a&nbsp;bezplatn\u011b s d\u011btmi nebo ml\u00e1de\u017e\u00ed (podm\u00ednka neplat\u00ed u t\u00e1bor\u016f pro zdravotn\u011b posti\u017een\u00e9 d\u011bti).<\/strong>&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Pokud zam\u011bstnanec tuto podm\u00ednku <strong>nespln\u00ed<\/strong>, mus\u00ed si pro \u00fa\u010dast nap\u0159\u00edklad vz\u00edt dovolenou nebo se domluvit na neplacen\u00e9m volnu.&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>D\u011bti a ml\u00e1de\u017e jsou <strong>fyzick\u00e9 osoby mlad\u0161\u00ed 26 let<\/strong>.&nbsp;<\/li>\n\n\n\n<li>Za <strong>soustavnou<\/strong> pr\u00e1ci se typicky pova\u017euje takov\u00e1 \u010dinnost, kde se aktivity opakuj\u00ed dle p\u0159edem dan\u00e9ho harmonogramu (nap\u0159. tr\u00e9ninky, z\u00e1jmov\u00e9 krou\u017eky, odd\u00edlov\u00e9 sch\u016fzky apod.), a to alespo\u0148 <strong>2\u00d7 m\u011bs\u00ed\u010dn\u011b<\/strong>. Pouze samotn\u00e1 ka\u017edoro\u010dn\u00ed \u00fa\u010dast na d\u011btsk\u00e9m t\u00e1bo\u0159e \u010di soust\u0159ed\u011bn\u00ed <strong>nen\u00ed <\/strong>soustavn\u00e1 pr\u00e1ce s d\u011btmi a ml\u00e1de\u017e\u00ed. Za poru\u0161en\u00ed soustavnosti se nepova\u017euje <strong>do\u010dasn\u00e9<\/strong> p\u0159eru\u0161en\u00ed t\u011bchto aktivit nap\u0159. z d\u016fvodu nemoci, \u0161koln\u00edch pr\u00e1zdnin apod.&nbsp;<\/li>\n\n\n\n<li>Podm\u00ednka bezplatnosti neznamen\u00e1, \u017ee uvoln\u011bn\u00fd zam\u011bstnanec mus\u00ed bezplatn\u011b vykon\u00e1vat i \u010dinnost, pro kterou byl uvoln\u011bn. Pokud s n\u00edm po\u0159adatel <strong>na dobu trv\u00e1n\u00ed t\u00e1bora<\/strong> uzav\u0159e nap\u0159. DPP, lze i p\u0159esto o refundaci za\u017e\u00e1dat.&nbsp;<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>2\/ Akci po\u0159\u00e1d\u00e1 pr\u00e1vnick\u00e1 osoba zapsan\u00e1 ve ve\u0159ejn\u00e9m rejst\u0159\u00edku pr\u00e1vnick\u00fdch a&nbsp;fyzick\u00fdch osob po dobu nejm\u00e9n\u011b 10 let a pr\u00e1ce s&nbsp;d\u011btmi a ml\u00e1de\u017e\u00ed tvo\u0159\u00ed podstatnou \u010d\u00e1st jej\u00ed hlavn\u00ed \u010dinnosti.<\/strong>&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Podm\u00ednka t\u00fdkaj\u00edc\u00ed se doby z\u00e1pisu a hlavn\u00ed \u010dinnosti je<strong> novinkou od 1. 1. 2024<\/strong>. Nyn\u00ed tedy nesta\u010d\u00ed, aby pr\u00e1ce s d\u011btmi a ml\u00e1de\u017e\u00ed byla pouze zahrnuta v hlavn\u00ed \u010dinnosti subjektu, ale nov\u011b tak\u00e9 <strong>mus\u00ed tvo\u0159it podstatnou<\/strong> t\u00e9to hlavn\u00ed \u010dinnosti.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">V p\u0159\u00edpad\u011b po\u0159\u00e1d\u00e1n\u00ed akce <strong>fyzickou osobou <\/strong>m\u00e1 zam\u011bstnanec n\u00e1rok na pracovn\u00ed volno, nicm\u00e9n\u011b n\u00e1hrada mzdy mu <strong>nep\u0159\u00edslu\u0161\u00ed<\/strong>, a to ani v p\u0159\u00edpad\u011b, kdy je tato osoba zaps\u00e1na ve ve\u0159ejn\u00e9m rejst\u0159\u00edku.\u00a0\u00a0<\/p>\n\n\n<div class=\"c-blog-highlight\" style=\"\">\r\n    <h2 class=\"c-blog-highlight__title\">\r\n            <\/h2>\r\n    <div class=\"c-blog-highlight__text\">\r\n        <p><strong>TIP:<\/strong> Detaily o prok\u00e1z\u00e1n\u00ed spln\u011bn\u00ed podm\u00ednek najdete <strong><a href=\"https:\/\/www.cssz.cz\/refundace-nahrady-mzdy\">na str\u00e1nk\u00e1ch \u010cSSZ<\/a><\/strong>, kde je nap\u0159. uvedeno, ze kter\u00fdch ve\u0159ejn\u00fdch rejst\u0159\u00edk\u016f je mo\u017en\u00e9 \u010derpat nebo co p\u0159esn\u011b znamen\u00e1 podstatn\u00e1 \u010d\u00e1st hlavn\u00ed \u010dinnosti.\u00a0<\/p>\n    <\/div>\r\n<\/div>\n\n\n<h2 class=\"wp-block-heading\"><strong>Stanoven\u00ed doby pro n\u00e1rok na n\u00e1hradu mzdy&nbsp;<\/strong>&nbsp;<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Nov\u011b n\u00e1hrada mzdy zam\u011bstnanci p\u0159\u00edslu\u0161\u00ed za po\u010det hodin pracovn\u00edho volna odpov\u00eddaj\u00edc\u00ed <strong>d\u00e9lce jeho stanoven\u00e9 (nebo krat\u0161\u00ed) t\u00fddenn\u00ed pracovn\u00ed doby<\/strong>. Pokud tedy zam\u011bstnanec pracuje nap\u0159. 40 h t\u00fddn\u011b (tj. 8 h denn\u011b), tak za jeden den pracovn\u00edho volna m\u00e1 n\u00e1rok n\u00e1hradu ve v\u00fd\u0161i t\u011bchto 8 h. P\u0159i pracovn\u00ed dob\u011b 30 h za t\u00fdden (tj. 6 h denn\u011b) m\u00e1 n\u00e1rok na 6 h apod.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Kdyby v pr\u016fb\u011bhu kalend\u00e1\u0159n\u00edho roku do\u0161lo ke<strong> zm\u011bn\u011b d\u00e9lky t\u00fddenn\u00ed pracovn\u00ed doby<\/strong>, pak se po\u010det hodin zb\u00fdvaj\u00edc\u00edch do ro\u010dn\u00edho limitu vyj\u00e1d\u0159\u00ed stejn\u00fdm pom\u011brem k t\u00e9to nov\u00e9 d\u00e9lce.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>P\u0159\u00edklad:&nbsp;<\/strong>&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Zam\u011bstnanec pracuje <strong>40 h t\u00fddn\u011b<\/strong> (= 8 h denn\u011b) a b\u011bhem akce pro d\u011bti a ml\u00e1de\u017e \u010derpal pracovn\u00ed volno v d\u00e9lce <strong>2 dny<\/strong> (= 16 h). T\u00edm vy\u010derpal <strong>40 % sv\u00e9ho ro\u010dn\u00edho limitu<\/strong>.&nbsp;<\/li>\n\n\n\n<li>Pot\u00e9 u n\u011bj do\u0161lo ke zm\u011bn\u011b t\u00fddenn\u00ed pracovn\u00ed doby na 20 h (= 4 h denn\u011b).&nbsp;<\/li>\n\n\n\n<li>Kdyby ve stejn\u00e9m kalend\u00e1\u0159n\u00edm roce cht\u011bl dal\u0161\u00ed pracovn\u00ed volno, mohl by vy\u010derpat <strong>u\u017e jen 3 dny<\/strong> (= 12 h), co\u017e je pr\u00e1v\u011b zb\u00fdvaj\u00edc\u00edch 60 % jeho limitu.&nbsp;<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Ur\u010den\u00ed v\u00fd\u0161e n\u00e1hrady mzdy a refundace pojistn\u00e9ho<\/strong>&nbsp;<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">N\u00e1hrada nov\u011b p\u0159\u00edslu\u0161\u00ed ve v\u00fd\u0161i <strong>pr\u016fm\u011brn\u00e9ho hodinov\u00e9ho v\u00fdd\u011blku<\/strong>, nejv\u00fd\u0161e v\u0161ak ve v\u00fd\u0161i <strong>jedn\u00e9 sto\u010dty\u0159iasedmdes\u00e1tiny pr\u016fm\u011brn\u00e9 mzdy<\/strong> v n\u00e1rodn\u00edm hospod\u00e1\u0159stv\u00ed za prvn\u00ed a\u017e t\u0159et\u00ed \u010dtvrtlet\u00ed kalend\u00e1\u0159n\u00edho roku, kter\u00fd p\u0159edch\u00e1z\u00ed kalend\u00e1\u0159n\u00edmu roku, kdy pracovn\u00ed volno poskytnete. Pr\u016fm\u011brnou mzdu zve\u0159ej\u0148uje <strong>\u010cesk\u00fd statistick\u00fd<\/strong> <strong>\u00fa\u0159ad <\/strong>a tento pod\u00edl vyhla\u0161uje <strong>MPSV<\/strong>.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Pro rok 2024 \u010din\u00ed pr\u016fm\u011brn\u00fd hodinov\u00fd v\u00fdd\u011blek (pod\u00edl) <strong>243,90 K\u010d<\/strong>, co\u017e je p\u0159i 40hodinov\u00e9 t\u00fddenn\u00ed pracovn\u00ed dob\u011b <strong>9 756 K\u010d <\/strong>(tj. max. v\u00fd\u0161e refundace od \u010cSSZ).&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Sv\u00e9mu zam\u011bstnanci samoz\u0159ejm\u011b m\u016f\u017eete proplatit i <strong>vy\u0161\u0161\u00ed n\u00e1hradu za pracovn\u00ed volno<\/strong>, nicm\u00e9n\u011b v\u0161e nad v\u00fd\u0161e uvedenou \u010d\u00e1stku zaplat\u00edte \u201eze sv\u00e9ho\u201c.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Spolu s refundac\u00ed n\u00e1hrady mzdy vrac\u00ed \u010cSSZ tak\u00e9 <strong>pojistn\u00e9 na soci\u00e1ln\u00ed a zdravotn\u00ed poji\u0161t\u011bn\u00ed<\/strong> za zam\u011bstnavatele (24,8 % SP + 9 % ZP z proplacen\u00e9 n\u00e1hrady), pojistn\u00e9 za zam\u011bstnance v\u0161ak nikoliv.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">O refundaci je mo\u017en\u00e9 za\u017e\u00e1dat <strong>nejpozd\u011bji 6 m\u011bs\u00edc\u016f<\/strong> po prob\u011bhnut\u00ed akce.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Postup a pot\u0159ebn\u00e9 podklady pro uzn\u00e1n\u00ed \u017e\u00e1dosti o&nbsp;refundaci<\/strong>&nbsp;<\/h2>\n\n\n\n<ol class=\"wp-block-list\" start=\"1\">\n<li>Zam\u011bstnanec doru\u010d\u00ed zam\u011bstnavateli<strong> \u017e\u00e1dost o poskytnut\u00ed pracovn\u00edho volna<\/strong> souvisej\u00edc\u00edho s akc\u00ed pro d\u011bti a ml\u00e1de\u017e \u2013 je dobr\u00e9, aby v t\u00e9to \u017e\u00e1dosti rovnou dolo\u017eil, \u017ee <strong>spl\u0148uje podm\u00ednku o soustavn\u00e9 a bezplatn\u00e9 pr\u00e1ci<\/strong> s d\u011btmi po dobu min. 1 roku (potvrzen\u00ed vyd\u00e1 po\u0159\u00e1daj\u00edc\u00ed t\u00e1bora\/soust\u0159ed\u011bn\u00ed). Vy jako zam\u011bstnavatel n\u00e1sledn\u011b prov\u011b\u0159\u00edte spln\u011bn\u00ed druh\u00e9 podm\u00ednky, \u017ee po\u0159\u00e1daj\u00edc\u00ed je zaps\u00e1n ve ve\u0159ejn\u00e9m rejst\u0159\u00edku<strong> nejm\u00e9n\u011b 10 let<\/strong>, pr\u00e1ce s d\u011btmi a ml\u00e1de\u017e\u00ed je zahrnuta v jeho<strong> hlavn\u00ed \u010dinnosti<\/strong> a tvo\u0159\u00ed jej\u00ed <strong>podstatnou \u010d\u00e1st<\/strong>.&nbsp;<\/li>\n<\/ol>\n\n\n\n<ol class=\"wp-block-list\" start=\"2\">\n<li>Zam\u011bstnanec n\u00e1sledn\u011b doru\u010d\u00ed zam\u011bstnavateli <strong>potvrzen\u00ed<\/strong>, \u017ee akce (t\u00e1bor\/soust\u0159ed\u011bn\u00ed) opravdu fyzicky prob\u011bhla \u2013 potvrzen\u00ed vyd\u00e1 po\u0159adatel akce.&nbsp;<\/li>\n<\/ol>\n\n\n\n<ol class=\"wp-block-list\" start=\"3\">\n<li>Zam\u011bstnavatel dolo\u017e\u00ed <strong>v\u00fdplatn\u00ed p\u00e1sku<\/strong> zam\u011bstnance za m\u011bs\u00edc, kdy mu byla proplacena n\u00e1hrada mzdy za prob\u011bhlou akci pro d\u011bti a ml\u00e1de\u017e.&nbsp;<\/li>\n<\/ol>\n\n\n\n<ol class=\"wp-block-list\" start=\"4\">\n<li>Zam\u011bstnavatel dolo\u017e\u00ed <strong>mzdov\u00fd list zam\u011bstnance a v\u00fdpis z \u00fa\u010dtu<\/strong>, \u017ee n\u00e1hradu opravdu proplatil (n\u00e1hrada se nemus\u00ed propl\u00e1cet zvl\u00e1\u0161\u0165, ale jako sou\u010d\u00e1st mzdy zam\u011bstnance).&nbsp;<\/li>\n<\/ol>\n\n\n\n<ol class=\"wp-block-list\" start=\"5\">\n<li>Na str\u00e1nk\u00e1ch \u010cSSZ zam\u011bstnavatel vypln\u00ed formul\u00e1\u0159 \u2013 <a href=\"https:\/\/eportal.cssz.cz\/web\/portal\/-\/tiskopisy\/zoupnm\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>\u017d\u00e1dost o \u00fahradu poskytnut\u00e9 n\u00e1hrady mzdy p\u0159i pracovn\u00edm volnu souvisej\u00edc\u00edm s akc\u00ed pro d\u011bti a&nbsp;ml\u00e1de\u017e<\/strong><\/a>.
