Firmy mus\u00ed zajistit<strong> rovn\u00e9 odm\u011bny za stejnou pr\u00e1ci<\/strong>, sd\u00edlet syst\u00e9m odm\u011b\u0148ov\u00e1n\u00ed a\u00a0dolo\u017eit, \u017ee nedoch\u00e1z\u00ed k\u00a0diskriminaci. Kdo m\u00e1 100 a\u00a0v\u00edce zam\u011bstnanc\u016f, \u010dekaj\u00ed ho nav\u00edc <strong>pravideln\u00e9 reporty<\/strong>.\u00a0<\/p>\n\n\n<div class=\"c-blog-highlight\" style=\"\">\r\n    <h2 class=\"c-blog-highlight__title\">\r\n            <\/h2>\r\n    <div class=\"c-blog-highlight__text\">\r\n        <p>V \u010cR se v&nbsp;n\u00e1vaznosti na novou sm\u011brnici chystaj\u00ed <strong>zm\u011bny n\u011bkolika z\u00e1kon\u016f<\/strong>: Z\u00e1kon\u00edku pr\u00e1ce, Ob\u010dansk\u00e9ho z\u00e1kon\u00edku a&nbsp;Ob\u010dansk\u00e9ho soudn\u00edho \u0159\u00e1du. Nejzaz\u0161\u00ed term\u00edn je stanoven na <\/strong>7. \u010dervna 2026<\/strong>.\u00a0<\/p>\n    <\/div>\r\n<\/div>\n\n\n<h2 class=\"wp-block-heading\"><strong>Rovnost, transparentnost i\u00a0nov\u00e1 administrativa a\u00a0sankce<\/strong>\u00a0<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Mezi hlavn\u00ed c\u00edle sm\u011brnice pat\u0159\u00ed:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>rovn\u00e9 odm\u011b\u0148ov\u00e1n\u00ed <\/strong>\u017een a\u00a0mu\u017e\u016f;\u00a0<\/li>\n\n\n\n<li>zamezen\u00ed diskriminace v\u00a0odm\u011b\u0148ov\u00e1n\u00ed;\u00a0<\/li>\n\n\n\n<li>zp\u0159\u00edsn\u011bn\u00ed <strong>povinnost\u00ed <\/strong>pro zam\u011bstnavatele p\u0159i kontrole spravedliv\u00e9ho odm\u011b\u0148ov\u00e1n\u00ed;\u00a0<\/li>\n\n\n\n<li>lep\u0161\u00ed pr\u00e1vn\u00ed mo\u017enosti pro mo\u017en\u00e9 <strong>postihov\u00e1n\u00ed diskriminace<\/strong>.\u00a0<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">D\u00e1le sm\u011brnice bude obsahovat z\u00e1konnou povinnost informovat zam\u011bstnance o\u00a0<strong>syst\u00e9mu odm\u011b\u0148ov\u00e1n\u00ed <\/strong>a\u00a0tak\u00e9 o\u00a0<strong>mo\u017enostech kari\u00e9rn\u00edho postupu<\/strong>.\u00a0<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">V neposledn\u00ed \u0159ad\u011b to nov\u011b budou zam\u011bstnavatel\u00e9, kdo bude prokazovat, \u017ee nedo\u0161lo k\u00a0diskriminaci \u2013 <strong>d\u016fkazn\u00ed b\u0159emeno se toti\u017e p\u0159esouv\u00e1 na jejich stranu<\/strong>.\u00a0<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Pokud se diskriminace <strong>prok\u00e1\u017ee<\/strong>, zam\u011bstnavatel bude muset:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>nahradit zam\u011bstnanci \u0161kodu bez jak\u00e9hokoli omezen\u00ed;\u00a0<\/li>\n\n\n\n<li>zaplatit sankci v\u00a0odrazuj\u00edc\u00ed v\u00fd\u0161i;\u00a0<\/li>\n\n\n\n<li>po\u010d\u00edtat s\u00a0rizikem vylou\u010den\u00ed z\u00a0dotac\u00ed nebo ve\u0159ejn\u00fdch zak\u00e1zek.\u00a0<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Po\u017eadavky na firmy \u2013 co bude pot\u0159eba splnit?<\/strong>&nbsp;<\/h2>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>1) Za stejnou pr\u00e1ci stejn\u00e1 odm\u011bna<\/strong>&nbsp;<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Zam\u011bstnavatel\u00e9 budou muset:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>zav\u00e9st <strong>jednotn\u00fd p\u0159\u00edstup<\/strong> k\u00a0odm\u011b\u0148ov\u00e1n\u00ed;\u00a0<\/li>\n\n\n\n<li>srovnat nejen z\u00e1kladn\u00ed mzdu, ale i <strong>p\u0159\u00edplatky, n\u00e1hrady, odm\u011bny a\u00a0benefity<\/strong> (v\u0161echny slo\u017eky mzdy budou p\u0159esn\u011b definov\u00e1ny v\u00a0\u010desk\u00e9 legislativ\u011b);\u00a0<\/li>\n\n\n\n<li>m\u00edt jasn\u00e1 pravidla pro p\u0159id\u011blov\u00e1n\u00ed bonus\u016f, n\u00e1rok\u016f na odm\u011bny apod.\u00a0<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Pro ka\u017edou skupinu zam\u011bstnanc\u016f (nap\u0159. d\u011bln\u00edci, obchodn\u00edci, mana\u017ee\u0159i) mus\u00ed b\u00fdt mo\u017en\u00e9 dolo\u017eit, \u017ee <strong>podm\u00ednky odm\u011b\u0148ov\u00e1n\u00ed jsou identick\u00e9<\/strong>.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>2) Report o odm\u011b\u0148ov\u00e1n\u00ed<\/strong>&nbsp;<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Zam\u011bstnavatel\u00e9 se <strong>100 a\u00a0v\u00edce zam\u011bstnanci<\/strong> budou tak\u00e9 povinni p\u0159ipravovat a\u00a0odes\u00edlat <strong>report<\/strong> o\u00a0rovn\u00e9m odm\u011b\u0148ov\u00e1n\u00ed. Ten bude mimo jin\u00e9 obsahovat:\u00a0<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>rozd\u00edly v odm\u011b\u0148ov\u00e1n\u00ed \u017een a\u00a0mu\u017e\u016f;\u00a0<\/li>\n\n\n\n<li>rozd\u00edly v dopl\u0148kov\u00fdch slo\u017ek\u00e1ch mezd;\u00a0<\/li>\n\n\n\n<li>pod\u00edl \u017een a mu\u017e\u016f, kte\u0159\u00ed dost\u00e1vaj\u00ed dopl\u0148kov\u00e9 slo\u017eky mezd apod.\u00a0<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Po\u017eadavky na reporting se budou li\u0161it <strong>podle po\u010dtu zam\u011bstnanc\u016f<\/strong>, co\u017e ovlivn\u00ed term\u00edn prvn\u00edho pod\u00e1n\u00ed a\u00a0tak\u00e9 frekvenci odes\u00edl\u00e1n\u00ed.\u00a0<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-fixed-layout\"><tbody><tr><td><strong>Po\u010det zam\u011bstnanc\u016f<\/strong>&nbsp;<\/td><td><strong>Term\u00edn 1. reportu<\/strong>&nbsp;<\/td><td><strong>Frekvence odevzd\u00e1n\u00ed<\/strong>&nbsp;<\/td><\/tr><tr><td>100\u2013149 zam\u011bstnanc\u016f&nbsp;<\/td><td>do 7. 6. 2031&nbsp;<\/td><td>ka\u017ed\u00e9 3 roky&nbsp;<\/td><\/tr><tr><td>150\u2013249 zam\u011bstnanc\u016f&nbsp;<\/td><td>do 7. 6. 2027&nbsp;<\/td><td>ka\u017ed\u00e9 3 roky&nbsp;<\/td><\/tr><tr><td>250 a v\u00edce zam\u011bstnanc\u016f&nbsp;<\/td><td>do 7. 6. 2027&nbsp;<\/td><td>ka\u017ed\u00fd rok&nbsp;<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>3) Tolerance max. 5% rozd\u00edlu ve mzd\u00e1ch \u017een a mu\u017e\u016f&nbsp;<\/strong>&nbsp;<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Rozd\u00edly v odm\u011b\u0148ov\u00e1n\u00ed mezi \u017eenami a\u00a0mu\u017ei <strong>nesm\u00ed p\u0159ekro\u010dit 5 %.<\/strong> Zohledn\u011bny samoz\u0159ejm\u011b budou faktory jako<strong> vzd\u011bl\u00e1n\u00ed, praxe nebo kvalifikace<\/strong> pro danou pozici. Pokud ov\u0161em rozd\u00edl i\u00a0po jejich zohledn\u011bn\u00ed p\u0159es\u00e1hne 5\u00a0%, bude ho muset zam\u011bstnavatel <strong>zd\u016fvodnit<\/strong> a\u00a0tak\u00e9 do p\u016fl roku <strong>sjednat n\u00e1pravu<\/strong>.\u00a0\u00a0<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>4) Transparentnost v odm\u011b\u0148ov\u00e1n\u00ed<\/strong>&nbsp;<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Informace o odm\u011bn\u00e1ch u\u017e nebudou firemn\u00edm tajemstv\u00edm. Sm\u011brnice zav\u00e1d\u00ed zm\u011bny <strong>ve sd\u00edlen\u00ed mzdov\u00fdch \u00fadaj\u016f<\/strong> i v\u00a0tom, co a\u00a0jak mus\u00edte sv\u00e9mu t\u00fdmu \u0159\u00edct.\u00a0<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Zam\u011bstnanci budou moci od zam\u011bstnavatel\u016f po\u017eadovat informace o\u00a0sv\u00fdch \u00farovn\u00edch odm\u011bn a\u00a0tak\u00e9 o\u00a0<strong>pr\u016fm\u011brn\u00fdch \u00farovn\u00edch odm\u011bn<\/strong> pro stejn\u00e9 pozice nebo pro pozice, kter\u00e9 maj\u00ed stejnou hodnotu.\u00a0<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Zam\u011bstnavatel\u00e9 z\u00e1rove\u0148 budou muset ka\u017ed\u00fd rok <strong>informovat v\u0161echny sv\u00e9 zam\u011bstnance o\u00a0jejich nov\u00fdch pr\u00e1vech a\u00a0zve\u0159ejnit<\/strong>:\u00a0<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Informace o\u00a0<strong>syst\u00e9mu<\/strong>, kter\u00fd se pou\u017e\u00edv\u00e1 pro stanoven\u00ed odm\u011b\u0148ov\u00e1n\u00ed.\u00a0<\/li>\n\n\n\n<li>P\u0159ehled \u00farovn\u00ed odm\u011b\u0148ov\u00e1n\u00ed.\u00a0<\/li>\n\n\n\n<li>Mo\u017enosti kari\u00e9rn\u00edho postupu, resp. mo\u017en\u00fd postup v\u00a0odm\u011b\u0148ov\u00e1n\u00ed zam\u011bstnanc\u016f.\u00a0<\/li>\n\n\n\n<li>Informace o <strong>n\u00e1stupn\u00ed mzd\u011b <\/strong>nebo o\u00a0rozp\u011bt\u00ed pro danou pracovn\u00ed pozici.\u00a0<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Zak\u00e1zan\u00e9 praktiky:<\/strong>&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Zam\u011bstnavatel\u00e9 <strong>nesm\u00ed <\/strong>zam\u011bstnanc\u016fm br\u00e1nit, aby mluvili <strong>o\u00a0v\u00fd\u0161i sv\u00e9 mzdy \u010di odm\u011bn<\/strong>. Smluvn\u00ed klauzule t\u00fdkaj\u00edc\u00ed se ml\u010denlivosti o\u00a0mzd\u011b budou <strong>neplatn\u00e9<\/strong>.\u00a0<\/li>\n\n\n\n<li>N\u00e1bor\u00e1\u0159i se nesm\u00ed <strong>pt\u00e1t kandid\u00e1t\u016f<\/strong>, kolik vyd\u011bl\u00e1vali u\u00a0p\u0159edchoz\u00edho zam\u011bstnavatele.\u00a0<\/li>\n\n\n\n<li>Nebude p\u0159\u00edpustn\u00e9 pou\u017e\u00edvat <strong>genderov\u011b zabarven\u00e9 n\u00e1zvy pracovn\u00edch pozic<\/strong> (nap\u0159. prodava\u010dka, kucha\u0159ka, technik), ale mus\u00ed b\u00fdt ozna\u010deny neutr\u00e1ln\u011b.\u00a0<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>P\u0159ipravte se na novou sm\u011brnici s p\u0159edstihem<\/strong>&nbsp;<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Sm\u011brnice p\u0159in\u00e1\u0161\u00ed v\u00edc ne\u017e jen pr\u00e1vn\u00ed \u00fapravy.
