Zamestn\u00e1vanie cudzincov z tzv. 3. kraj\u00edn (v\u0161etk\u00fdch kraj\u00edn mimo E\u00da) je aktu\u00e1lne ve\u013emi roz\u0161\u00edrenou praxou. Jedn\u00e1 sa pritom o nejednoduch\u00fd proces ako pre cudzinca = potenci\u00e1lneho zamestnanca, tak pre zamestn\u00e1vate\u013ea samotn\u00e9ho. V tejto s\u00favislosti sme si dovolili pripravi\u0165 pre V\u00e1s nasleduj\u00faci \u010dl\u00e1nok, ktor\u00fd sa venuje problematike zamestn\u00e1vania ob\u010danov 3. kraj\u00edn.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Zamestnanie \u0161t\u00e1tnych pr\u00edslu\u0161n\u00edkov tret\u00edch kraj\u00edn je komplexnou z\u00e1le\u017eitos\u0165ou. Podmienky zamestn\u00e1vania cudzincov upravuje Z\u00e1kon o slu\u017eb\u00e1ch zamestnanosti (\u010d. 5\/2004 Z. z).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u200d<strong>Od 1.1.2014 sa zaviedli nov\u00e9 formy zamestnania \u0161t\u00e1tnych pr\u00edslu\u0161n\u00edkov tret\u00edch kraj\u00edn na \u00fazem\u00ed SR:<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">a) s potvrden\u00edm o mo\u017enosti obsadenia vo\u013en\u00e9ho pracovn\u00e9ho miesta (VPM),<br>b) s potvrden\u00edm o mo\u017enosti obsadenia VPM zodpovedaj\u00faceho vysokokvalifikovan\u00e9mu zamestnaniu (s\u00favisiace so \u017eiados\u0165ou o modr\u00fa kartu E\u00da),<br>c) s povolen\u00edm na zamestnanie,<br>d) povolenie na zamestnanie ani potvrdenie o mo\u017enosti obsadenia VPM sa nevy\u017eaduje.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u200d<strong>Zamestn\u00e1vate\u013e m\u00f4\u017ee zamestn\u00e1va\u0165 len \u0161t\u00e1tneho pr\u00edslu\u0161n\u00edka tretej krajiny, ktor\u00fd:<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">a) je dr\u017eite\u013eom modrej karty Eur\u00f3pskej \u00fanie,<br>b) m\u00e1 udelen\u00fd prechodn\u00fd pobyt na \u00fa\u010del zamestnania na z\u00e1klade potvrdenia o mo\u017enosti obsadenia vo\u013en\u00e9ho pracovn\u00e9ho miesta,<br>c) m\u00e1 udelen\u00e9 povolenie na zamestnanie a udelen\u00fd prechodn\u00fd pobyt na \u00fa\u010del zamestnania,<br>d) m\u00e1 udelen\u00e9 povolenie na zamestnanie a udelen\u00fd prechodn\u00fd pobyt na \u00fa\u010del zl\u00fa\u010denia rodiny,<br>e) m\u00e1 udelen\u00e9 povolenie na zamestnanie a udelen\u00fd prechodn\u00fd pobyt \u0161t\u00e1tneho pr\u00edslu\u0161n\u00edka tretej krajiny, ktor\u00fd m\u00e1 priznan\u00e9 postavenie osoby s dlhodob\u00fdm pobytom v \u010dlenskom \u0161t\u00e1te Eur\u00f3pskej \u00fanie,<br>f) sp\u013a\u0148a podmienky pod\u013ea \u00a7 23 a).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u0160t\u00e1tny pr\u00edslu\u0161n\u00edk tretej krajiny pod\u013ea odseku 1 p\u00edsm. a) a\u017e e) m\u00f4\u017ee by\u0165 zamestnan\u00fd len v pracovnom pomere.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Postupy pri zamestn\u00e1van\u00ed jednotliv\u00fdch kateg\u00f3ri\u00ed zamestnancov s\u00fa uveden\u00e9 na str\u00e1nke \u00dastredia pr\u00e1ce, soci\u00e1lnych vec\u00ed a rodiny. Str\u00e1nka \u00daPSVaR na z\u00e1klade z\u00e1konn\u00e9ho r\u00e1mca podrobne informuje o z\u00e1konn\u00fdch postupoch a povinnostiach zamestn\u00e1vate\u013ea, ako aj o povinnostiach \u0161t\u00e1tneho pr\u00edslu\u0161n\u00edka tretej krajiny.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"http:\/\/www.upsvar.sk\/sluzby-zamestnanosti\/zamestnavanie-cudzincov.html?page_id=272197\">http:\/\/www.upsvar.sk\/sluzby-zamestnanosti\/zamestnavanie-cudzincov.html?page_id=272197<\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u200d<strong>Po n\u00e1stupe cudzincov m\u00e1 zamestn\u00e1vate\u013e nasledovn\u00e9 povinnosti:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>vy\u017eiada\u0165 si od \u0161t\u00e1tneho pr\u00edslu\u0161n\u00edka tretej krajiny pred jeho prijat\u00edm do zamestnania platn\u00fd doklad o pobyte a uchov\u00e1va\u0165 k\u00f3piu dokladu o pobyte najmenej po\u010das trvania jeho zamestnania, zamestn\u00e1vate\u013e sleduje, \u010di je na pobytovej karte uveden\u00e9 opr\u00e1vnenie pracova\u0165<\/li>\n\n\n\n<li>na z\u00e1klade opr\u00e1vnenia pracova\u0165 za \u00fa\u010delom \u0161t\u00fadia rozli\u0161ujeme cudzinca:<br>&#8211; ktor\u00fd m\u00e1 udelen\u00fd prechodn\u00fd pobyt na \u00fa\u010del \u0161t\u00fadia, ak osobitn\u00fd predpis neustanovuje inak, okrem posluch\u00e1\u010da jazykovej \u0161koly, a v\u00fdkon jeho pr\u00e1ce nepresiahne u v\u0161etk\u00fdch zamestn\u00e1vate\u013eov 10 hod\u00edn t\u00fd\u017edenne<br>&#8211; alebo 20 hod\u00edn t\u00fd\u017edenne, ak je \u0161tudentom vysokej \u0161koly, alebo tomu zodpovedaj\u00faci po\u010det dn\u00ed alebo mesiacov za rok,<\/li>\n\n\n\n<li>najnesk\u00f4r do siedmich pracovn\u00fdch dn\u00ed p\u00edsomne informova\u0165 \u00farad, ak \u0161t\u00e1tny pr\u00edslu\u0161n\u00edk tretej krajiny, ktor\u00e9mu bolo udelen\u00e9 povolenie na zamestnanie, nenast\u00fapil do zamestnania alebo jeho zamestnanie sa skon\u010dilo pred uplynut\u00edm obdobia ur\u010den\u00e9ho v povolen\u00ed na zamestnanie,<\/li>\n\n\n\n<li>uzatvori\u0165 pracovnopr\u00e1vny vz\u0165ah v s\u00falade so Z\u00e1konn\u00edkom pr\u00e1ce,<\/li>\n\n\n\n<li>v pr\u00edpade zamestn\u00e1vania \u0161t\u00e1tneho pr\u00edslu\u0161n\u00edka tretej krajiny, ktor\u00fd nepotrebuje povolenie na zamestnanie, alebo potvrdenie o mo\u017enosti obsadenia vo\u013en\u00e9ho pracovn\u00e9ho miesta, alebo rodinn\u00e9ho pr\u00edslu\u0161n\u00edka ob\u010dana E\u00da \u2013 ozn\u00e1mi\u0165 za\u010diatok a skon\u010denie jeho zamestnania pr\u00edslu\u0161n\u00e9mu \u00faradu pr\u00e1ce, soci\u00e1lnych vec\u00ed a rodiny pod\u013ea miesta v\u00fdkonu pr\u00e1ce do 7 pracovn\u00fdch dn\u00ed prostredn\u00edctvom formul\u00e1ra \u201eInforma\u010dn\u00e1 karta o vzniku\/skon\u010den\u00ed pracovnopr\u00e1vneho vz\u0165ahu alebo o vyslan\u00ed na v\u00fdkon pr\u00e1ce\/skon\u010den\u00ed vyslania na v\u00fdkon pr\u00e1ce \u0161t\u00e1tneho pr\u00edslu\u0161n\u00edka tretej krajiny uveden\u00e9ho v \u00a723a ods. 1 z\u00e1kona o slu\u017eb\u00e1ch zamestnanosti\u201c, v dvoch vyhotoveniach, spolu s k\u00f3piou dokladu o uzatvoren\u00ed pracovnopr\u00e1vneho vz\u0165ahu (k\u00f3pia pracovnej zmluvy) a s dokladom preukazuj\u00facim skuto\u010dnos\u0165 plnenia v\u00fdnimky (napr\u00edklad k\u00f3pia identifika\u010dnej karti\u010dky z cudzineckej pol\u00edcie, z ktorej je uveden\u00e1 v\u00fdnimka zrejm\u00e1; v pr\u00edpade ukon\u010den\u00e9ho \u0161t\u00fadia na Slovensku \u2013 diplom),<\/li>\n\n\n\n<li>ak \u0161t\u00e1tny pr\u00edslu\u0161n\u00edk tretej krajiny m\u00e1 pracovnopr\u00e1vny vz\u0165ah, alebo obdobn\u00fd vz\u0165ah u viacer\u00fdch zamestn\u00e1vate\u013eov na \u00fazem\u00ed SR, ka\u017ed\u00fd z jeho zamestn\u00e1vate\u013eov m\u00e1 ohlasovaciu povinnos\u0165,<\/li>\n\n\n\n<li>pred n\u00e1stupom do zamestnania prihl\u00e1si\u0165 zamestnanca v pr\u00edslu\u0161nej pobo\u010dke Soci\u00e1lnej pois\u0165ovne,<\/li>\n\n\n\n<li>do 8 pracovn\u00fdch dn\u00ed prihl\u00e1si\u0165 zamestnanca v pr\u00edslu\u0161nej zdravotnej pois\u0165ovni,<\/li>\n\n\n\n<li>po skon\u010den\u00ed pracovnopr\u00e1vneho vz\u0165ahu odhl\u00e1si\u0165 zamestnanca vo v\u0161etk\u00fdch in\u0161tit\u00faci\u00e1ch,<\/li>\n\n\n\n<li>v pr\u00edpade zamestn\u00e1vania \u0161t\u00e1tneho pr\u00edslu\u0161n\u00edka tretej krajiny na z\u00e1klade dohody o hos\u0165ovan\u00ed \u2013 do 2 mesiacov informova\u0165 Ministerstvo \u0161kolstva, vedy, v\u00fdskumu a \u0161portu SR o:<br>&#8211; pred\u010dasnom ukon\u010den\u00ed dohody o hos\u0165ovan\u00ed,<br>&#8211; skuto\u010dnosti, ktor\u00e1 nazna\u010duje ukon\u010denie \u00fa\u010dasti cudzinca na projekte v\u00fdskumu a v\u00fdvoja v priebehu 2 mesiacov,<br>&#8211; ukon\u010den\u00ed projektu v\u00fdskumu a v\u00fdvoja,<br>&#8211; ukon\u010den\u00ed dohody o hos\u0165ovan\u00ed,<br>o skuto\u010dnosti, ktor\u00e1 br\u00e1ni rie\u0161eniu projektu v\u00fdskumu a v\u00fdvoja.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">\u200d<strong>POZOR !!!<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Od 5. 5. 2017 v pr\u00edpade vyslania \u0161t\u00e1tneho pr\u00edslu\u0161n\u00edka tretej krajiny zamestn\u00e1vate\u013eom z in\u00e9ho \u010dlensk\u00e9ho \u0161t\u00e1tu v r\u00e1mci poskytovania slu\u017eieb zabezpe\u010den\u00fdch t\u00fdmto zamestn\u00e1vate\u013eom m\u00e1 pr\u00edjemca slu\u017eby povinnos\u0165 informova\u0165 pr\u00edslu\u0161n\u00fd \u00farad pr\u00e1ce, soci\u00e1lnych vec\u00ed a rodiny do 7 pracovn\u00fdch dn\u00ed na predp\u00edsanom formul\u00e1ri.
