Zamestnanec \u2013 mu\u017e m\u00e1 v s\u00favislosti so starostlivos\u0165ou o die\u0165a pr\u00e1vo na rodi\u010dovsk\u00fa dovolenku.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Matersk\u00e1 dovolenka<\/strong>&nbsp;<strong>je ospravedlnen\u00e9 obdobie<\/strong>, na ktor\u00e9 m\u00e1 pr\u00e1vo ka\u017ed\u00e1 zamestnan\u00e1 \u017eena. Pl\u00e1novan\u00fd n\u00e1stup na matersk\u00fa dovolenku a rodi\u010dovsk\u00fa dovolenku, ukon\u010denie alebo zmeny spolu s ozn\u00e1men\u00edm o tehotenstve je nutn\u00e9&nbsp;<strong>ozn\u00e1mi\u0165 zamestn\u00e1vate\u013eovi minim\u00e1lne 1 mesiac vopred<\/strong>&nbsp;spolu s odovzdan\u00edm potvrden\u00e9ho tla\u010diva od o\u0161etruj\u00faceho gynekol\u00f3ga.<br>Pod\u013ea Z\u00e1konn\u00edka pr\u00e1ce je tehotnou zamestnanky\u0148ou zamestnanky\u0148a, ktor\u00e1 svojho zamestn\u00e1vate\u013ea p\u00edsomne informovala o svojom stave a predlo\u017eila o tom lek\u00e1rske potvrdenie.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>P\u00edsomn\u00e9 ozn\u00e1menie by malo obsahova\u0165 inform\u00e1cie o tom:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>v ktorom t\u00fd\u017edni sa zamestnanky\u0148a nach\u00e1dza<\/li>\n\n\n\n<li>kedy pl\u00e1nuje n\u00e1stup na matersk\u00fa dovolenku,<\/li>\n\n\n\n<li>d\u00e1tum a podpis,<\/li>\n\n\n\n<li>prilo\u017een\u00e9 lek\u00e1rske potvrdenie.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Zamestnanky\u0148a, ktor\u00e1 p\u00edsomne ozn\u00e1mila tehotenstvo zamestn\u00e1vate\u013eovi, mu nie je povinn\u00e1 dodato\u010dne predklada\u0165 \u010fal\u0161ie potvrdenia.<br>P\u00edsomn\u00e9 informovanie zamestn\u00e1vate\u013ea o existuj\u00facom tehotenstve poskytuje zamestnankyni&nbsp;<strong>ochrann\u00fa lehotu<\/strong>, po\u010das ktorej jej&nbsp;<strong>zamestn\u00e1vate\u013e nem\u00f4\u017ee da\u0165 v\u00fdpove\u010f.<\/strong>&nbsp;Ochrann\u00e1 lehota plat\u00ed od doru\u010denia ozn\u00e1menia o tehotenstve aj po\u010das \u010derpania materskej a rodi\u010dovskej dovolenky.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Matersk\u00e1 dovolenka pod\u013ea \u00a7 166 ods. 1 Z\u00e1konn\u00edka pr\u00e1ce<\/strong>&nbsp;patr\u00ed v s\u00favislosti s p\u00f4rodom a starostlivos\u0165ou o naroden\u00e9 die\u0165a&nbsp;<strong>\u017eene v trvan\u00ed 34 t\u00fd\u017ed\u0148ov<\/strong>.&nbsp;<strong>Osamelej \u017eene<\/strong>&nbsp;patr\u00ed matersk\u00e1 dovolenka v<strong>&nbsp;trvan\u00ed 37 t\u00fd\u017ed\u0148ov<\/strong>&nbsp;a&nbsp;<strong>\u017eene, ktor\u00e1 porodila z\u00e1rove\u0148 dve alebo viac det\u00ed, patr\u00ed matersk\u00e1 dovolenka v trvan\u00ed 43 t\u00fd\u017ed\u0148ov<\/strong>. Je preto potrebn\u00e9, aby zamestnanky\u0148a informovala svojho zamestn\u00e1vate\u013ea pri n\u00e1stupe na matersk\u00fa dovolenku, \u010di m\u00e1\/nem\u00e1 status osamelej matky. Soci\u00e1lna pois\u0165ov\u0148a pre \u00fa\u010dely vypl\u00e1cania d\u00e1vok matersk\u00e9ho rozli\u0161uje partnersk\u00fa osamelos\u0165 matky a ekonomick\u00fa osamelos\u0165 matky. Matka, ktor\u00e1 nie je vydat\u00e1, av\u0161ak \u017eije s otcom die\u0165a\u0165a, sa nepova\u017euje za partnersky osamel\u00fa. Za ekonomicky osamel\u00fa matku sa nepova\u017euje matka, ktor\u00e1 \u017eije v dom\u00e1cnosti s inou fyzickou osobou (napr. s rodi\u010dom) a spolo\u010dne uhr\u00e1dzaj\u00fa n\u00e1klady spojen\u00e9 s chodom dom\u00e1cnosti (n\u00e1jomn\u00e9, in\u00e9 \u00fahrady spojen\u00e9 s chodom dom\u00e1cnosti). Osamel\u00e1 matka osamelos\u0165 preukazuje \u010destn\u00fdm vyhl\u00e1sen\u00edm, v ktorom okrem d\u00f4vodu osamelosti uvedie aj pr\u00e1vnu zodpovednos\u0165 nepravdiv\u00e9ho vyhl\u00e1senia. K \u010destn\u00e9mu vyhl\u00e1seniu prilo\u017e\u00ed fotok\u00f3piu dokladu o d\u00f4vode osamelosti (napr. \u00famrtn\u00fd list man\u017eela alebo rozhodnutie s\u00fadu o rozvode), ak tak\u00fdto doklad m\u00e1. Ak pobo\u010dka Soci\u00e1lnej pois\u0165ovne zist\u00ed, \u017ee inform\u00e1cie v \u010destnom vyhl\u00e1sen\u00ed nie s\u00fa pravdiv\u00e9, matersk\u00e9 vyplat\u00ed len do konca 34. t\u00fd\u017ed\u0148a od vzniku n\u00e1roku na matersk\u00e9. Soci\u00e1lna pois\u0165ov\u0148a taktie\u017e m\u00f4\u017ee od\u0148a\u0165 v\u00fdplatu matersk\u00e9ho, ak sa preuk\u00e1\u017ee nesplnenie podmienky osamelosti v obdob\u00ed od za\u010diatku 35. t\u00fd\u017ed\u0148a do konca 37. t\u00fd\u017ed\u0148a poberania d\u00e1vky matersk\u00e9ho alebo predp\u00edsa\u0165 preplatok na materskom, ak sa \u010destn\u00e9 vyhl\u00e1senie dodato\u010dne preuk\u00e1\u017ee ako nepravdiv\u00e9.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">V s\u00favislosti so starostlivos\u0165ou o naroden\u00e9 die\u0165a patr\u00ed aj mu\u017eovi od narodenia die\u0165a\u0165a rodi\u010dovsk\u00e1 dovolenka v rovnakom rozsahu, ak sa star\u00e1 o naroden\u00e9 die\u0165a. Obdobie trvania tejto materskej (rodi\u010dovskej) dovolenky sa posudzuje ako v\u00fdkon pr\u00e1ce.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Matersk\u00e1 d\u00e1vka<\/strong>&nbsp;nie je poskytovan\u00e1 automaticky, je potrebn\u00e9 o \u0148u po\u017eiada\u0165. Pri \u017eiadan\u00ed o matersk\u00fa d\u00e1vku je potrebn\u00e9 vyplni\u0165 formul\u00e1r&nbsp;<strong>\u017diados\u0165 o matersk\u00e9<\/strong>(vyd\u00e1 gynekol\u00f3g) a za zamestnanky\u0148u po\u0161le na pobo\u010dku Soci\u00e1lnej pois\u0165ovne zamestn\u00e1vate\u013e. \u017diados\u0165 o matersk\u00e9 sa vyp\u013a\u0148a nasledovne:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Predn\u00e1 strana formul\u00e1ra:<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>\u010cas\u0165 A. Potvrdenie opr\u00e1vnen\u00e9ho lek\u00e1ra:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>meno a priezvisko poistenkyne<\/li>\n\n\n\n<li>adresa trval\u00e9ho\/prechodn\u00e9ho pobytu<\/li>\n\n\n\n<li>n\u00e1zov a adresa zamestn\u00e1vate\u013ea<\/li>\n\n\n\n<li>pravdepodobn\u00fd d\u00e1tum p\u00f4rodu<\/li>\n\n\n\n<li>obdobie do\u010dasnej PN od \u2013 do<\/li>\n\n\n\n<li>d\u00e1tum vyplnenia \u010dasti A. + pe\u010diatka a podpis opr\u00e1vnen\u00e9ho lek\u00e1ra<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>\u010cas\u0165 B. Poistenky\u0148a:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>zamestnanky\u0148a vypln\u00ed d\u00e1tum od kedy si uplat\u0148uje n\u00e1rok na matersk\u00e9 (t. j. 6 \u2013 max. 8 t\u00fd\u017ed\u0148ov pred o\u010dak\u00e1van\u00fdm d\u0148om p\u00f4rodu)<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>\u010cas\u0165 C. In\u00fd poistenec:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>vyp\u013a\u0148a in\u00fd poistenec, ktor\u00fd si uplat\u0148uje n\u00e1rok na matersk\u00e9 namiesto tehotnej zamestnankyne<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>\u010cas\u0165 D. Potvrdenie zamestn\u00e1vate\u013ea:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>v tejto \u010dasti zamestn\u00e1vate\u013e vypln\u00ed d\u00e1tum od kedy je poskytnut\u00e1 matersk\u00e1\/rodi\u010dovsk\u00e1 dovolenka + vypln\u00ed d\u00e1tum kedy naposledy pracovala zamestnanky\u0148a\/pracoval in\u00fd poistenec + zamestn\u00e1vate\u013e dopln\u00ed pe\u010diatku, podpis a d\u00e1tum potvrdenia formul\u00e1ra<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">D\u00e1tum vyplnen\u00fd&nbsp;<strong>v \u010dasti B<\/strong>. sa pova\u017euje za d\u00e1tum n\u00e1stupu na matersk\u00fa dovolenku.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Zadn\u00e1 strana formul\u00e1ra:<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>VYHL\u00c1SENIE POISTENKYNE\/POISTENCA:<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">zamestnanky\u0148a v tejto \u010dasti uv\u00e1dza:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>\u010di si uplat\u0148uje\/neuplat\u0148uje n\u00e1rok na matersk\u00e9 aj z in\u00e9ho poistenia<\/li>\n\n\n\n<li>\u010d\u00edslo \u00fa\u010dtu, na ktor\u00e9 si praje pouk\u00e1za\u0165 d\u00e1vku matersk\u00e9ho\/adresu svojho bydliska, ak si praje vyplati\u0165 d\u00e1vku matersk\u00e9ho v hotovosti<\/li>\n\n\n\n<li>d\u00e1tum + svoj podpis<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Z\u00e1znamy pobo\u010dky Soci\u00e1lnej pois\u0165ovne:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>\u00fadaje v tejto spodnej \u010dasti zadnej strany formul\u00e1ra vyp\u013a\u0148a v\u00fdlu\u010dne pracovn\u00edk soci\u00e1lnej pois\u0165ovne<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">N\u00e1rok na matersk\u00e9 m\u00e1 predov\u0161etk\u00fdm \u017eena, ktor\u00e1 je tehotn\u00e1 alebo sa star\u00e1 o naroden\u00e9 die\u0165a a ktor\u00e1 bola&nbsp;<strong>v posledn\u00fdch dvoch rokoch pred p\u00f4rodom nemocensky poisten\u00e1 najmenej 270 dn\u00ed<\/strong>&nbsp;(zhruba 9 mesiacov).&nbsp;<strong>Poistenie za \u0148u platil bu\u010f zamestn\u00e1vate\u013e<\/strong>&nbsp;alebo si ho platila ako \u017eivnostn\u00ed\u010dka alebo dobrovo\u013ene nezamestnan\u00e1 osoba.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Rodi\u010dovsk\u00e1 dovolenka na preh\u013abenie starostlivosti o die\u0165a pod\u013ea \u00a7 166 ods. 2 Z\u00e1konn\u00edka pr\u00e1ce<\/strong>&nbsp;patr\u00ed \u017eene a mu\u017eovi, ktor\u00ed o to po\u017eiadaj\u00fa, a to a\u017e do d\u0148a, v ktorom die\u0165a dov\u0155\u0161i&nbsp;<strong>tri roky veku<\/strong>, a ak ide&nbsp;<strong>o dlhodobo nepriazniv\u00fd zdravotn\u00fd stav die\u0165a\u0165a<\/strong>&nbsp;vy\u017eaduj\u00faci osobitn\u00fa starostlivos\u0165 a\u017e do d\u0148a, v ktorom die\u0165a dov\u0155\u0161i&nbsp;<strong>\u0161es\u0165 rokov veku<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Dlhodobo nepriazniv\u00fd zdravotn\u00fd stav die\u0165a\u0165a je:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>choroba a stav uveden\u00e9 v pr\u00edlohe \u010d. 2 z\u00e1kona o soci\u00e1lnom poisten\u00ed, ktor\u00e9 pod\u013ea poznatkov lek\u00e1rskej vedy trvaj\u00fa viac ako dvan\u00e1s\u0165 po sebe nasleduj\u00facich kalend\u00e1rnych mesiacov alebo je predpoklad, \u017ee bud\u00fa trva\u0165 viac ako dvan\u00e1s\u0165 po sebe nasleduj\u00facich kalend\u00e1rnych mesiacov, a vy\u017eaduj\u00fa osobitn\u00fa starostlivos\u0165 pod\u013ea tejto pr\u00edlohy, alebo<\/li>\n\n\n\n<li>choroba a stav vy\u017eaduj\u00face osobitn\u00fa starostlivos\u0165, ak choroba a stav vylu\u010duj\u00fa schopnos\u0165 s\u00fastavne sa pripravova\u0165 na povolanie a vykon\u00e1va\u0165 z\u00e1robkov\u00fa \u010dinnos\u0165.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Po uplynut\u00ed materskej dovolenky sa spravidla odpor\u00fa\u010da necha\u0165 si preplati\u0165 u zamestn\u00e1vate\u013ea zostatkov\u00fa riadnu dovolenku.<br>Po skon\u010den\u00ed materskej dovolenky a pred n\u00e1stupom na rodi\u010dovsk\u00fa dovolenku m\u00f4\u017ee zamestnanky\u0148a za\u017eiada\u0165 o \u010derpanie riadnej dovolenky. Pri \u017eiadan\u00ed o rodi\u010dovsk\u00fa dovolenku je potrebn\u00e9 dolo\u017ei\u0165 rodn\u00fd list die\u0165atka (najlep\u0161ie dolo\u017ei\u0165 hne\u010f po naroden\u00ed) a vyplni\u0165 formul\u00e1r&nbsp;<strong>\u017diados\u0165 o \u010derpanie riadnej a rodi\u010dovskej dovolenky<\/strong>, ktor\u00fd sa vyp\u013a\u0148a nasledovne:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>v hornej \u010dasti formul\u00e1ra zamestnanky\u0148a vypln\u00ed svoje meno, priezvisko, d\u00e1tum narodenia, adresu trval\u00e9ho bydliska, osobn\u00e9 \u010d\u00edslo<\/li>\n\n\n\n<li>v bode 1) zamestnanky\u0148a vypln\u00ed d\u00e1tum, od kedy m\u00e1 n\u00e1rok \u010derpa\u0165 riadnu dovolenku<br>(t. j. nasleduj\u00faci de\u0148 po skon\u010den\u00ed materskej dovolenky)<\/li>\n\n\n\n<li>v bode 2) zamestnanky\u0148a vypln\u00ed d\u00e1tum, do kedy m\u00e1 n\u00e1rok \u010derpa\u0165 rodi\u010dovsk\u00fa dovolenku<br>(t. j. max. do 3 rokov veku die\u0165a\u0165a)<\/li>\n\n\n\n<li>miesto, d\u0148a + podpis zamestnankyne.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Pozn\u00e1mka:<\/strong>&nbsp;Ak\u00e9ko\u013evek zmeny rozhoduj\u00face pre poskytnutie MD\/RD je zamestnanky\u0148a povinn\u00e1 nahl\u00e1si\u0165 najnesk\u00f4r do 5 dn\u00ed mzdov\u00e9mu oddeleniu.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Spolu so \u017diados\u0165ou o \u010derpanie riadnej a rodi\u010dovskej dovolenky mus\u00ed zamestnanky\u0148a dolo\u017ei\u0165 aj&nbsp;<strong>rodn\u00fd list die\u0165atka<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Zamestn\u00e1vate\u013e je povinn\u00fd nahl\u00e1si\u0165 obdobie trvania MD a RD na soci\u00e1lnu a zdravotn\u00fa pois\u0165ov\u0148u.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Dovolenku za kalend\u00e1rny rok, na ktor\u00fa zamestnancovi vznikol n\u00e1rok t\u00fdm, \u017ee&nbsp;<strong>splnil podmienku odpracovania aspo\u0148 60 dn\u00ed v kalend\u00e1rnom roku<\/strong>, m\u00f4\u017ee zamestn\u00e1vate\u013e kr\u00e1ti\u0165 za prv\u00fdch 100 zame\u0161kan\u00fdch pracovn\u00fdch dn\u00ed z d\u00f4vodu \u010derpania rodi\u010dovskej dovolenky pod\u013ea \u00a7 166 ods. 2 Z\u00e1konn\u00edka pr\u00e1ce o jednu dvan\u00e1stinu a za ka\u017ed\u00fdch \u010fal\u0161\u00edch 21 zame\u0161kan\u00fdch pracovn\u00fdch dn\u00ed rovnako o jednu dvan\u00e1stinu.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Z uveden\u00e9ho vypl\u00fdva, \u017ee&nbsp;<strong>za obdobie trvania materskej (rodi\u010dovskej) dovolenky pod\u013ea \u00a7 166 ods. 1 Z\u00e1konn\u00edka pr\u00e1ce, ktor\u00e9 sa posudzuje ako v\u00fdkon pr\u00e1ce, vznik\u00e1 zamestnankyni (zamestnancovi) n\u00e1rok na riadnu dovolenku za kalend\u00e1rny rok, a to v pr\u00edpade, ak do pr\u00edslu\u0161n\u00e9ho kalend\u00e1rneho roka spad\u00e1 tak\u00e1 \u010das\u0165 tejto materskej (rodi\u010dovskej) dovolenky, ktor\u00e1 zodpoved\u00e1 obdobiu vykon\u00e1vania pr\u00e1ce v rozsahu 60 dn\u00ed.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ak si zamestnanky\u0148a (zamestnanec) nem\u00f4\u017ee vy\u010derpa\u0165 dovolenku pre \u010derpanie materskej dovolenky alebo rodi\u010dovskej dovolenky ani do konca nasleduj\u00faceho kalend\u00e1rneho roka po roku, v ktorom n\u00e1rok na dovolenku vznikol,&nbsp;<strong>nevy\u010derpan\u00fa dovolenku jej (mu) zamestn\u00e1vate\u013e poskytne po skon\u010den\u00ed materskej dovolenky alebo rodi\u010dovskej dovolenky.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Sk\u00fa\u0161obn\u00e1 doba<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Pod\u013ea Z\u00e1konn\u00edka pr\u00e1ce m\u00e1 zamestn\u00e1vate\u013e mo\u017enos\u0165 ukon\u010di\u0165 pracovn\u00fd pomer s tehotnou zamestnanky\u0148ou v sk\u00fa\u0161obnej dobe, a to p\u00edsomne s n\u00e1le\u017eit\u00fdm od\u00f4vodnen\u00edm.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Pracovn\u00fd pomer na dobu ur\u010dit\u00fa<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Zamestn\u00e1vate\u013e nem\u00f4\u017ee da\u0165 v\u00fdpove\u010f tehotnej zamestnankyni v ochrannej dobe. Pri tehotn\u00fdch zamestnankyniach, ktor\u00e9 maj\u00fa uzavret\u00fd pracovn\u00fd pomer na dobu ur\u010dit\u00fa s platn\u00fdm term\u00ednom ukon\u010denia pracovn\u00e9ho pomeru v\u0161ak nejde o v\u00fdpove\u010f (ide o skon\u010denie pracovn\u00e9ho pomeru uplynut\u00edm doby ur\u010ditej), a teda zamestn\u00e1vate\u013e neporu\u0161uje z\u00e1kaz v\u00fdpovede a pracovn\u00fd pomer nemus\u00ed pred\u013a\u017ei\u0165 (ani v \u010dase tehotenstva, materskej \u010di rodi\u010dovskej dovolenky).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Preru\u0161enie\/skr\u00e1tenie materskej a rodi\u010dovskej dovolenky<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ak die\u0165a zo zdravotn\u00fdch d\u00f4vodov prevzal do starostlivosti doj\u010densk\u00fd \u00fastav alebo in\u00fd lie\u010debn\u00fd \u00fastav a \u017eena a mu\u017e zatia\u013e nast\u00fapi do pr\u00e1ce, preru\u0161\u00ed sa t\u00fdmto n\u00e1stupom matersk\u00e1 dovolenka a rodi\u010dovsk\u00e1 dovolenka najsk\u00f4r po uplynut\u00ed 6 t\u00fd\u017ed\u0148ov odo d\u0148a p\u00f4rodu. Jej nevy\u010derpan\u00e1 \u010das\u0165 sa \u017eene a mu\u017eovi poskytne odo d\u0148a, ke\u010f prevzal die\u0165a z \u00fastavu op\u00e4\u0165 do svojej starostlivosti a prestal preto pracova\u0165, nie v\u0161ak dlh\u0161ie ako do 3 rokov veku die\u0165a\u0165a.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u017dene a mu\u017eovi, ktor\u00fd sa prestal stara\u0165 o naroden\u00e9 die\u0165a, a ktor\u00e9ho die\u0165a bolo z tohto d\u00f4vodu umiestnen\u00e9 do starostlivosti nahr\u00e1dzaj\u00facej starostlivos\u0165 rodi\u010dov, ako aj \u017eene a mu\u017eovi, ktor\u00e9ho die\u0165a je v do\u010dasnej starostlivosti detsk\u00e9ho domova alebo obdobn\u00e9ho \u00fastavu z in\u00fdch ako zdravotn\u00fdch d\u00f4vodov, nepatr\u00ed matersk\u00e1 dovolenka a rodi\u010dovsk\u00e1 dovolenka za obdobie, po\u010das ktor\u00e9ho sa o die\u0165a nestar\u00e1.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ak sa die\u0165a narodilo m\u0155tve, patr\u00ed \u017eene matersk\u00e1 dovolenka po dobu 14 t\u00fd\u017ed\u0148ov.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ak die\u0165a zomrie v dobe, ke\u010f je \u017eena na materskej dovolenke alebo \u017eena a mu\u017e na rodi\u010dovskej dovolenke, poskytuje sa im t\u00e1to dovolenka e\u0161te po\u010das 2 t\u00fd\u017ed\u0148ov odo d\u0148a \u00famrtia die\u0165a\u0165a, najdlh\u0161ie do d\u0148a, ke\u010f by die\u0165a dosiahlo 1 rok.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Matersk\u00e1 dovolenka v s\u00favislosti s p\u00f4rodom nesmie by\u0165 krat\u0161ia ako 14 t\u00fd\u017ed\u0148ov a nem\u00f4\u017ee sa skon\u010di\u0165 ani preru\u0161i\u0165 pred uplynut\u00edm 6 t\u00fd\u017ed\u0148ov odo d\u0148a p\u00f4rodu.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>N\u00e1rok in\u00fdch os\u00f4b na matersk\u00fa a rodi\u010dovsk\u00fa dovolenku<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">N\u00e1rok na matersk\u00fa dovolenku a rodi\u010dovsk\u00fa dovolenku m\u00e1 aj \u017eena a mu\u017e, ktor\u00fd prevzal na z\u00e1klade pr\u00e1voplatn\u00e9ho rozhodnutia pr\u00edslu\u0161n\u00e9ho org\u00e1nu die\u0165a do starostlivosti nahr\u00e1dzaj\u00facej starostlivos\u0165 rodi\u010dov, ktor\u00e9 mu bolo zveren\u00e9 rozhodnut\u00edm pr\u00edslu\u0161n\u00fdch org\u00e1nov na neskor\u0161ie osvojenie alebo do pest\u00fanskej starostlivosti, alebo die\u0165a, ktor\u00e9ho matka zomrela.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">V tomto pr\u00edpade sa matersk\u00e1 dovolenka alebo rodi\u010dovsk\u00e1 dovolenka poskytuje \u017eene a mu\u017eovi odo d\u0148a prevzatia die\u0165a\u0165a v trvan\u00ed 28 t\u00fd\u017ed\u0148ov, osamelej \u017eene a osamel\u00e9mu mu\u017eovi v trvan\u00ed 31 t\u00fd\u017ed\u0148ov a \u017eene a mu\u017eovi, ktor\u00fd prevzal dve deti alebo viac det\u00ed, sa poskytuje v trvan\u00ed 37 t\u00fd\u017ed\u0148ov, najdlh\u0161ie do d\u0148a, v ktorom die\u0165a dov\u0155\u0161i tri roky veku.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Rodi\u010dovsk\u00e1 dovolenka sa poskytuje v trvan\u00ed 3 rokov odo d\u0148a prevzatia die\u0165a\u0165a a v trvan\u00ed 6 rokov odo d\u0148a prevzatia die\u0165a\u0165a s dlhodobo nepriazniv\u00fdm zdravotn\u00fdm stavom vy\u017eaduj\u00facim osobitn\u00fa starostlivos\u0165, najdlh\u0161ie do d\u0148a, k\u00fdm die\u0165a dosiahne \u0161es\u0165 rokov veku.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Rizikov\u00e9 tehotenstvo<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Zamestnankyne, ktor\u00e9 po\u010das tehotenstva musia nast\u00fapi\u0165 na rizikov\u00e9 tehotenstvo, s\u00fa posudzovan\u00e9 ako pr\u00e1ceneschopn\u00e9.
