D\u013a\u017eku trvania pr\u00e1ceneschopnosti stanovuje o\u0161etruj\u00faci lek\u00e1r pod\u013ea zdravotn\u00e9ho stavu pacienta. O\u0161etruj\u00facim lek\u00e1rom m\u00f4\u017ee by\u0165 iba:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>v\u0161eobecn\u00fd lek\u00e1r alebo lek\u00e1r so \u0161pecializ\u00e1ciou v odbore gynekol\u00f3gia a p\u00f4rodn\u00edctvo,<\/li>\n\n\n\n<li>lek\u00e1r zdravotn\u00edckeho zariadenia \u00fastavnej starostlivosti.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">V z\u00e1vislosti od trvania pracovnej neschopnosti, m\u00e1 zamestnanec n\u00e1rok na:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>n\u00e1hradu pr\u00edjmu od zamestn\u00e1vate\u013ea (prv\u00fdch desa\u0165 kalend\u00e1rnych dn\u00ed PN),<\/li>\n\n\n\n<li>nemocensk\u00e9 hraden\u00e9 Soci\u00e1lnou pois\u0165ov\u0148ou (od jeden\u00e1steho kalend\u00e1rneho d\u0148a PN).<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Pr\u00edslu\u0161n\u00fd o\u0161etruj\u00faci lek\u00e1r m\u00f4\u017ee uzna\u0165 osobu za do\u010dasne pr\u00e1ceneschopn\u00fa sp\u00e4tne najviac tri kalend\u00e1rne dni na z\u00e1klade lek\u00e1rskeho n\u00e1lezu lek\u00e1rskej slu\u017eby prvej pomoci alebo \u00fastavnej pohotovostnej slu\u017eby.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u200d<strong>Po\u010das pr\u00e1ceneschopnosti mus\u00ed zamestn\u00e1vate\u013e poskytn\u00fa\u0165 zamestnancovi n\u00e1hradu mzdy<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Po\u010das trvania pracovnej neschopnosti je zamestn\u00e1vate\u013e povinn\u00fd poskytn\u00fa\u0165 zamestnancovi n\u00e1hradu pr\u00edjmu. N\u00e1hrada pr\u00edjmu sa poskytuje za kalend\u00e1rne dni, a to od prv\u00e9ho d\u0148a PN do skon\u010denia PN, najdlh\u0161ie v\u0161ak do desiateho d\u0148a PN (zapo\u010d\u00edtavaj\u00fa sa aj sviatky a v\u00edkend). Ak bol zamestnanec o\u0161etren\u00fd po odpracovan\u00ed pracovnej zmeny, PN sa za\u010d\u00edna nasleduj\u00faci kalend\u00e1rny de\u0148. Zamestnanec je povinn\u00fd preuk\u00e1za\u0165 skuto\u010dnosti, ktor\u00e9 s\u00fa rozhoduj\u00face na vznik, trvanie, v\u00fd\u0161ku a z\u00e1nik n\u00e1roku na n\u00e1hradu pr\u00edjmu.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">V\u00fd\u0161ka n\u00e1hrady pr\u00edjmu z\u00e1vis\u00ed od toho \u201eko\u013ek\u00fd\u201c de\u0148 je zamestnanec pr\u00e1ceneschopn\u00fd:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>od prv\u00e9ho d\u0148a PN do tretieho d\u0148a PN je n\u00e1hrada pr\u00edjmu vo v\u00fd\u0161ke 25 % z denn\u00e9ho vymeriavacieho z\u00e1kladu zamestnanca,<\/li>\n\n\n\n<li>od \u0161tvrt\u00e9ho d\u0148a PN do desiateho d\u0148a PN je n\u00e1hrada pr\u00edjmu vo v\u00fd\u0161ke 55 % z denn\u00e9ho vymeriavacieho z\u00e1kladu.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">1. Ak je zamestnanec do\u010dasne pr\u00e1ceneschopn\u00fd z d\u00f4vodu stavu, ktor\u00fd si privodil pou\u017eit\u00edm alkoholu alebo in\u00fdch n\u00e1vykov\u00fdch l\u00e1tok, patr\u00ed mu n\u00e1rok na n\u00e1hradu mzdy vo v\u00fd\u0161ke polovice n\u00e1hrady pr\u00edjmu, na ktor\u00fa by mu inak vznikol n\u00e1rok.<br>2. N\u00e1hrada pr\u00edjmu pri do\u010dasnej PN sa vypl\u00e1ca zamestnancovi vo v\u00fdplatn\u00fdch term\u00ednoch ur\u010den\u00fdch na v\u00fdplatu mzdy, odmeny, platu, najnesk\u00f4r v\u0161ak do konca kalend\u00e1rneho mesiaca, ktor\u00fd nasleduje po mesiaci, za ktor\u00fdch si zamestnanec n\u00e1hradu pr\u00edjmu pri PN uplatnil.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u200d<strong>Ako si n\u00e1rok na n\u00e1hradu pr\u00e1ceneschopnosti uplatni\u0165?<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Zamestnanec si n\u00e1rok na n\u00e1hradu pr\u00e1ceneschopnosti uplatn\u00ed tak, \u017ee zamestn\u00e1vate\u013eovi predlo\u017e\u00ed&nbsp;<strong>Potvrdenie o do\u010dasnej PN<\/strong>&nbsp;(tla\u010divo nie je vo\u013ene k dispoz\u00edcii), ktor\u00e9 mus\u00ed obsahova\u0165 inform\u00e1ciu, o ak\u00fa d\u00e1vku \u017eiada (nemocensk\u00e9 alebo \u00farazov\u00fd pr\u00edplatok), sp\u00f4sob poukazovania a podpis zamestnanca. Potvrdenie vystav\u00ed zamestnancovi o\u0161etruj\u00faci lek\u00e1r. Toto potvrdenie obsahuje p\u00e4\u0165 \u010dast\u00ed, pri\u010dom:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>na za\u010diatku vypln\u00ed, podp\u00ed\u0161e zamestnanec a odovzd\u00e1 zamestn\u00e1vate\u013eovi\u00a0<strong>\u010das\u0165 II \u017diados\u0165 o nemocensk\u00e9 (\u010derven\u00fd papier)<\/strong>\u00a0\u2013 zamestnanec si takto uplat\u0148uje n\u00e1rok na nemocensk\u00fa d\u00e1vku, n\u00e1rok na nemocensk\u00fa d\u00e1vku vznik\u00e1 od jeden\u00e1steho d\u0148a PN a uhr\u00e1dza ho Soci\u00e1lna pois\u0165ov\u0148a (dovtedy je vypl\u00e1can\u00e1 zamestnancovi n\u00e1hrada mzdy, ktor\u00fa plat\u00ed zamestn\u00e1vate\u013e). Pred odovzdan\u00edm dokumentu zamestn\u00e1vate\u013eovi\/odoslan\u00edm Soci\u00e1lnej pois\u0165ovni je povinn\u00fd vyzna\u010di\u0165, o ktor\u00fa d\u00e1vku \u017eiada (nemocensk\u00e9 a\/alebo \u00farazov\u00fd pr\u00edplatok), \u00fadaje vo vyhl\u00e1sen\u00ed (\u010di uplat\u0148uje n\u00e1rok na d\u00e1vku zo s\u00fabehu poistenia a sp\u00f4sob poukazovania d\u00e1vky), doplni\u0165 \u010d\u00edslo \u00fa\u010dtu v pr\u00edpade, \u017ee po\u017eaduje, aby mu bolo nemocensk\u00e9 zaslan\u00e9 na bankov\u00fd \u00fa\u010det a podp\u00edsa\u0165 ho.<\/li>\n\n\n\n<li>na za\u010diatku vypln\u00ed, podp\u00ed\u0161e zamestnanec a odovzd\u00e1 zamestn\u00e1vate\u013eovi\u00a0<strong>\u010das\u0165<\/strong>\u00a0<strong>IIa \u017diados\u0165 o n\u00e1hradu pr\u00edjmu pri do\u010dasnej pracovnej neschopnosti zamestnanca (\u010dierny papier)<\/strong>\u00a0\u2013 zamestnanec si takto uplat\u0148uje n\u00e1rok na n\u00e1hradu pr\u00edjmu u zamestn\u00e1vate\u013ea, n\u00e1rok na n\u00e1hradu pr\u00edjmu od zamestn\u00e1vate\u013ea vznik\u00e1 od prv\u00e9ho d\u0148a PN do desiateho d\u0148a PN.<\/li>\n\n\n\n<li>pri ukon\u010den\u00ed PN vypln\u00ed, podp\u00ed\u0161e zamestnanec a odovzd\u00e1 zamestn\u00e1vate\u013eovi\u00a0<strong>\u010das\u0165 IV Hl\u00e1senie zamestn\u00e1vate\u013eovi a pobo\u010dke Soci\u00e1lnej pois\u0165ovne o skon\u010den\u00ed do\u010dasnej pracovnej neschopnosti (\u010dierny papier)<\/strong>\u00a0\u2013 ide o hl\u00e1senie zamestn\u00e1vate\u013eovi a pobo\u010dke Soci\u00e1lnej pois\u0165ovne o skon\u010den\u00ed do\u010dasnej PN. Hl\u00e1senie zamestn\u00e1vate\u013eovi a pobo\u010dke Soci\u00e1lnej pois\u0165ovne o skon\u010den\u00ed do\u010dasnej pracovnej neschopnosti &#8211; po podp\u00edsan\u00ed vyhl\u00e1senia je poistenec povinn\u00fd bezodkladne zasla\u0165 pobo\u010dke, ktor\u00e1 vypl\u00e1ca nemocensk\u00e9 (s v\u00fdnimkou zamestnanca, ktor\u00e9ho do\u010dasn\u00e1 pracovn\u00e1 neschopnos\u0165 trvala najviac 10 dn\u00ed &#8211; ten ho odovzd\u00e1 zamestn\u00e1vate\u013eovi).<\/li>\n\n\n\n<li>Diel\u00a0<strong>I. Legitim\u00e1ciu do\u010dasnej pracovnej neschopnosti (zelen\u00fd papier)<\/strong>\u00a0si pacient ponech\u00e1va po\u010das trvania celej PN u seba. Po skon\u010den\u00ed pr\u00e1ceneschopnosti I. diel odovzd\u00e1 svojmu o\u0161etruj\u00facemu lek\u00e1rovi. Legitim\u00e1cia do\u010dasne pr\u00e1ceneschopn\u00e9ho poistenca &#8211; t\u00fdmto dielom sa poistenec preukazuje zamestnancovi Soci\u00e1lnej pois\u0165ovne vykon\u00e1vaj\u00facemu kontrolu dodr\u017eiavania lie\u010debn\u00e9ho re\u017eimu a na tomto diele lek\u00e1r vyzna\u010duje d\u00e1tum kontroly; po skon\u010den\u00ed do\u010dasnej pracovnej neschopnosti ho poistenec odovzd\u00e1 lek\u00e1rovi.<\/li>\n\n\n\n<li>v pr\u00edpade, \u017ee do\u010dasn\u00e1 pracovn\u00e1 neschopnos\u0165 prekra\u010duje kalend\u00e1rny mesiac, je potrebn\u00e9 ku koncu ka\u017ed\u00e9ho mesiaca trvania PN predlo\u017ei\u0165 zamestn\u00e1vate\u013eovi\/Soci\u00e1lnej pois\u0165ovni dokument, ktor\u00fd potvrdzuje, \u017ee PN st\u00e1le pokra\u010duje a zamestnancovi patr\u00ed n\u00e1hrada pr\u00edjmu\/nemocensk\u00e9. Dokument preukazuj\u00faci tento n\u00e1rok sa naz\u00fdva\u00a0<strong>Preukaz o trvan\u00ed do\u010dasnej pracovnej neschopnosti \u2013 (l\u00edstok na peniaze orientovan\u00fd vodorovne)<\/strong><\/li>\n\n\n\n<li>Ak PN vznikla v d\u00f4sledku \u00farazu, je potrebn\u00e9 prilo\u017ei\u0165 k \u017eiadosti o nemocensk\u00e9 vyplnen\u00e9 a podp\u00edsan\u00e9 tla\u010divo\u00a0<strong>Hl\u00e1senie \u00farazu na \u00fa\u010dely nemocensk\u00e9ho<\/strong><\/li>\n\n\n\n<li>Ostatn\u00e9 diely potvrden\u00ed (I. diel po skon\u010den\u00ed do\u010dasnej pracovnej neschopnosti a III. Diel pri jej za\u010diatku) je povinn\u00fd odosla\u0165 lek\u00e1r zdravotn\u00edckeho zariadenia Soci\u00e1lnej pois\u0165ovni do evidencie do\u010dasne pr\u00e1ceneschopn\u00fdch poistencov.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">\u200d<strong>N\u00e1rok na n\u00e1hrady pr\u00edjmu nem\u00e1 zamestnanec, ak:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>po\u010das trvania PN m\u00e1 n\u00e1rok na nemocensk\u00e9, matersk\u00e9 alebo rodi\u010dovsk\u00fd pr\u00edspevok,<\/li>\n\n\n\n<li>sa stal do\u010dasne PN z d\u00f4vodu \u00famyseln\u00e9ho trestn\u00e9ho \u010dinu, za ktor\u00fd mu bol ulo\u017een\u00fd trest od\u0148atia slobody,<\/li>\n\n\n\n<li>poru\u0161il lie\u010debn\u00fd re\u017eim ur\u010den\u00fd lek\u00e1rom,<\/li>\n\n\n\n<li>sa po\u010das do\u010dasnej PN nezdr\u017eiava na mieste ur\u010denom lek\u00e1rom.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">\u200d<strong>Denn\u00fd vymeriavac\u00ed z\u00e1klad na \u00fa\u010dely v\u00fdpo\u010dtu n\u00e1hrady pr\u00edjmu pri do\u010dasnej pr\u00e1ceneschopnosti<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">1. nemocensk\u00e9 poistenie zamestnanca trvalo nepretr\u017eite najmenej 1 kalend\u00e1rny rok nepretr\u017eite od 1. janu\u00e1ra potom sa pou\u017eije denn\u00fd vymeriavac\u00ed z\u00e1klad z predch\u00e1dzaj\u00faceho kalend\u00e1rneho roka, v ktorom vznikla do\u010dasn\u00e1 pracovn\u00e1 neschopnos\u0165<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">2. obdobie nemocensk\u00e9ho poistenia, za ktor\u00e9 sa plat\u00ed poistn\u00e9 na nemocensk\u00e9 poistenie bolo najmenej 90 dn\u00ed pred d\u0148om, v ktorom vznikla do\u010dasn\u00e1 pracovn\u00e1 neschopnos\u0165, potom je rozhodn\u00e9 obdobie pre zistenie DVZ obdobie od vzniku nemocensk\u00e9ho poistenia do konca kalend\u00e1rneho mesiaca predch\u00e1dzaj\u00faceho kalend\u00e1rnemu mesiacu, v ktorom vznikla do\u010dasn\u00e1 pracovn\u00e1 neschopnos\u0165<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">V\u00fd\u0161ka poskytnutej n\u00e1hrady pri do\u010dasnej pr\u00e1ceneschopnosti sa ur\u010duje z denn\u00e9ho vymeriavacieho z\u00e1kladu (pr\u00edpadne pravdepodobn\u00e9ho vymeriavacieho z\u00e1kladu). Denn\u00fd vymeriavac\u00ed z\u00e1klad sa vypo\u010d\u00edta ako A\/B, kde:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A = s\u00fa\u010det vymeriavac\u00edch z\u00e1kladov, z ktor\u00fdch zamestnanec v kalend\u00e1rom roku, ktor\u00fd predch\u00e1dza kalend\u00e1rnemu roku, v ktorom vznikla do\u010dasn\u00e1 PN platil poistn\u00e9 na nemocensk\u00e9 poistenie (rozhoduj\u00face obdobie),<br>B = po\u010det kalend\u00e1rnych dn\u00ed rozhoduj\u00faceho obdobia.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Znamen\u00e1 to, \u017ee ak pracovn\u00e1 neschopnos\u0165 vznikla v roku 2016, pre v\u00fdpo\u010det n\u00e1hrady pr\u00edjmu bude rozhoduj\u00face obdobie rok 2015.<br>Ak povinn\u00e9 nemocensk\u00e9 poistenie za\u010dalo v priebehu roku 2015 alebo 2016 a zamestnanec je v priebehu roku 2016 do\u010dasne PN (a nemocensk\u00e9 poistenie sa platilo aspo\u0148 90 dn\u00ed pred d\u0148om vzniku n\u00e1roku na n\u00e1hradu pr\u00edjmu), rozhoduj\u00face obdobie na \u00fa\u010dely v\u00fdpo\u010dtu denn\u00e9ho vymeriavacieho z\u00e1kladu sa posudzuje:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>ako obdobie od vzniku nemocensk\u00e9ho poistenia do konca kalend\u00e1rneho mesiaca, ktor\u00fd predch\u00e1dza mesiacu, v ktorom PN vznikla.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">3. poistn\u00e9 na nemocensk\u00e9 poistenie bolo menej ako 90 dn\u00ed pred d\u0148om, v ktorom vznikla do\u010dasn\u00e1 pracovn\u00e1 neschopnos\u0165, rozhoduj\u00face obdobie na zistenie DVZ je obdobie od vzniku nemocensk\u00e9ho poistenia do konca kalend\u00e1rneho mesiaca predch\u00e1dzaj\u00faceho kalend\u00e1rnemu mesiacu, v ktorom vznikla do\u010dasn\u00e1 pracovn\u00e1 neschopnos\u0165 vr\u00e1tane \u010dasti toho mesiaca , kedy vznikla.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">V ka\u017edom pr\u00edpade je potrebn\u00e9 postupova\u0165 v s\u00falade so z\u00e1konom \u010d. 462\/2003 o n\u00e1hrade pr\u00edjmu pri do\u010dasnej pracovnej neschopnosti zamestnanca a o zmene a doplnen\u00ed niektor\u00fdch z\u00e1konov.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Denn\u00fd vymeriavac\u00ed z\u00e1klad sa zaokr\u00fah\u013euje na \u0161tyri desatinn\u00e9 miesta nadol, pri\u010dom je stanoven\u00e1 jeho maxim\u00e1lna hodnota.&nbsp;<strong>Pre rok 2017 je to suma 58,0602 eur<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u200d<strong>Pr\u00edklad na v\u00fdpo\u010det n\u00e1hrady pr\u00edjmu pri do\u010dasnej pr\u00e1ceneschopnosti<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">P\u00e1n Emil je zamestnancom spolo\u010dnosti AB, s.r.o. od 1. augusta 2015. N\u00e1stupn\u00fd plat bol 800 \u20ac a po skon\u010den\u00ed sk\u00fa\u0161obnej doby (od novembra 2015) sa zv\u00fd\u0161il na 880 \u20ac. Tla\u010divo sa vypisuje v tom pr\u00edpade, ak PN prech\u00e1dza z jedn\u00e9ho mesiaca do druh\u00e9ho, napr. za\u010dala v auguste a pokra\u010duje aj v septembri a z\u00e1rove\u0148 trv\u00e1 dlh\u0161ie ako desa\u0165 dn\u00ed. Vystavuje ho pre zamestnanca o\u0161etruj\u00faci lek\u00e1r.<br>Po skon\u010den\u00ed do\u010dasnej pracovnej neschopnosti vystav\u00ed o\u0161etruj\u00faci lek\u00e1r Hl\u00e1senie zamestn\u00e1vate\u013eovi a pobo\u010dke Soci\u00e1lnej pois\u0165ovne o skon\u010den\u00ed do\u010dasnej pracovnej neschopnosti (ide o IV. \u010das\u0165 Potvrdenia o do\u010dasnej pracovnej neschopnosti). Origin\u00e1l tla\u010diva post\u00fapi zamestn\u00e1vate\u013e Soci\u00e1lnej pois\u0165ovni najnesk\u00f4r do troch dn\u00ed po skon\u010den\u00ed PN, ak trvala viac ako desa\u0165 dn\u00ed. Zamestn\u00e1vate\u013e si ponech\u00e1 k\u00f3piu tla\u010diva.
